1. Agreement to Terms

By accessing or using PartPulse ("the App," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

PartPulse is a mobile marketplace application that enables users to buy, sell, and trade PC components, complete builds, and related hardware. The Service includes features such as:

  • Marketplace listings for PC parts and components
  • Real-time messaging between buyers and sellers
  • AI-powered PC build recommendations
  • User reviews and ratings system
  • Price alerts and notifications
  • Seller verification system
  • Analytics tools for sellers

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.

4. Marketplace Rules

4.1 Listings

When creating listings, you agree to:

  • Provide accurate descriptions and images of items
  • Set fair and honest prices
  • Accurately represent the condition of items
  • Only list items you legally own and have the right to sell
  • Respond promptly to buyer inquiries
  • Honor agreed-upon transactions

4.2 Prohibited Items

You may not list:

  • Stolen or illegally obtained items
  • Counterfeit or replica products
  • Items that infringe intellectual property rights
  • Hazardous materials or recalled products
  • Items prohibited by law
  • Non-PC related items without approval

4.3 Transactions

PartPulse facilitates connections between buyers and sellers. We are not a party to transactions between users. Users are responsible for:

  • Negotiating and completing transactions
  • Arranging payment methods
  • Handling shipping or local pickup
  • Resolving disputes between parties

5. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm other users
  • Post false, misleading, or deceptive content
  • Attempt to circumvent fees or policies
  • Use automated systems to access the Service
  • Interfere with the proper working of the Service
  • Collect user data without consent
  • Impersonate others or misrepresent your affiliation
  • Engage in spam or fraudulent activities

6. Content and Intellectual Property

6.1 User Content

You retain ownership of content you submit. By posting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.

6.2 Our Intellectual Property

The Service and its original content, features, and functionality are owned by PartPulse and are protected by copyright, trademark, and other intellectual property laws.

7. Fees and Subscriptions

PartPulse offers both free and premium subscription plans. Premium features may include:

  • Enhanced AI recommendations
  • Listing boosts and promotions
  • Advanced analytics
  • Priority support

Subscription fees are billed in advance. Refunds are handled according to app store policies.

8. Verification System

Our optional seller verification system requires identity verification. Verified status indicates identity confirmation only and does not guarantee transaction outcomes or seller reliability.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • The accuracy or reliability of user content
  • The quality or safety of listed items
  • That transactions will be completed satisfactorily
  • Uninterrupted or error-free service
  • The accuracy of AI recommendations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY TRANSACTIONS BETWEEN USERS.

11. Indemnification

You agree to indemnify and hold harmless PartPulse from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except for claims that may be brought in small claims court. You waive the right to participate in class actions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes. Continued use of the Service after changes constitutes acceptance of the new Terms.
